Perkbox End User Terms and Conditions of Sale
Please read these Perkbox End User Terms and Conditions of Sale (“Terms of Sale”) carefully before proceeding and placing an Order. By placing an Order, you agree to be bound by these Terms of Sale.
If you do not accept these Terms of Sale, you will not be able to order or purchase any Products from us.
If you view these Terms of Sale via our Website or App, you should print a copy of these Terms or save them to your device for future reference.
Definitions:
You or your, means you, the End User ordering and purchasing Products;
We, us or our, means Perkbox Limited (company number 07355963, registered address: 3 Dorset Rise, London, EC4Y 8EN, United Kingdom);
Order means an order placed by you for an accepted purchase of a Product through our Website or App;
Our Agreement means our agreement as defined in clause 2;
Privacy Policy means our Privacy Policy, full details of which can be found on at https://www.perkbox.com/uk/privacy;
Product(s), means the products in the Rewards Catalogue;
Terms, means these terms and conditions of sale;
Website, means the website https://www.perkbox.com/uk;
App, means the Perkbox App;
Rewards Catalogue means where all the Products will be available for purchase;
Reward Points means the points available to you for use within your Perkbox account;
Partner means Partner Helix Global Solutions Inc., a corporation founded under the laws of Canada;
Price(s) means the number of Rewards Points it costs to purchase a Product.
1. Prevail clause
These Terms of Sale are in addition to the Perkbox End User Terms of Service. If there is a conflict between these Terms and the Perkbox End User Terms of Service, these Terms of Sale shall prevail for any issues related to the purchase of Products via the Rewards Catalogue only.
2. Our Agreement
Each Order you place and purchase of Product(s) you make is subject to these Terms of Sale, and any additional terms that apply if and when give or any promotional or special offers (together “our Agreement”).
Perkbox may amend these Terms of Sale from time to time. You will be subject to the terms and conditions that are in force at the time that you place an Order.
3. Your Order
When you place an Order with us, you do so in accordance with these Terms of Sale of our Agreement subject to our acceptance of your Order. Your Order can take upto five (5) weeks to be processed.
Once processed, you will receive an email acknowledging receipt of your order, together with your order number and details of the Product(s) you have ordered.
We may choose not to accept your Order for any reason and we will not be liable to you or to anyone else in those circumstances. If we do not accept your Order (whether in whole or in part) we will refund any Reward Points used in connection with that Order (or that part of the order that we do not accept).
Your Order will be fulfilled by our Partner as defined in these Terms. Our Partner will process your data solely on our documented instructions and for the purposes of fulfilling your Order only. Please see our Privacy Policy for more details.
You cannot amend your Order including name and delivery address once you have placed an Order.
You will only be able to place a successful Order for delivery within the country your Perkbox account is registered in.
4. Your purchase(s)
Product(s)
The Product(s) in the Rewards Catalogue remain subject to change periodically depending on stock levels. We cannot guarantee the availability of any Product(s) as this changes on a regular basis.
We will take reasonable steps to display as accurately as possible the colours, appearance and other detailing of our Products in the images that appear in the Rewards Catalogue on our Website or App.
However, we do not guarantee that the images, appearance and other detailing will exactly reflect the colour, appearance or detailing of the physical Product. Products may vary slightly from the images on our Website or App.
The Products may show some colour variation. To the extent permitted by law, we accept no liability associated with such variations.
Any information on the Rewards Catalogue regarding sizing, weights, capacities, specifications, dimensions and measurements of Products is included as an estimated guide only.
Depending on your location, some Products may not be available to purchase and the Price of a Product may differ.
Where eligible, Products come with a standard one (1) year manufacturer’s warranty.
5. Price and Payment
You will see the Price of each Product in the Rewards Catalogue. We may update our Prices at any time.
From time to time we may apply promotional Prices to Products. These promotional Prices will only apply in the context in which the promotion is given and are subject to these Terms of Sale and any additional specific terms of that promotion, if any.
All Products are subject to availability. If you order a Product(s) which is not available, your Order may, at our discretion, be substituted or cancelled and the associated Price will be refunded to your
Perkbox End User account if the Order is cancelled.
Prices for Products include delivery charges unless expressly stated otherwise.
You remain responsible to pay any custom charges which may become due and payable upon purchase of a Product.
Payment for an Order can only be made via Rewards Points through the Website or App.
6. Shipping and Tracking
Shipping of your Order can take upto five (5) weeks from the date you place your Order. Tracking details will be available once your Order has been shipped.
Your Order will be delivered within two (2) weeks of the shipping date.
Subject to availability and these delivery terms, we will use reasonable endeavours to deliver your Order as per the estimated delivery time above; however please note that time shall not be of the essence for any such deliveries.
7. Cancellation and Returns
This cancellation and refunds section will apply to all Products you purchase from the Rewards Catalogue.
Cooling Off Period. You have the right to cancel and return your Order within fourteen (14) Business days from the date after you receive your Product.
Product(s) must be unopened, unused and returned in the same condition that you received it with tags, an unbroken seal where applicable and original manufacturers packaging, if any, to be eligible for a refund. This means that you must not use the Products except to the extent reasonably necessary to inspect and examine them or we may refuse your refund.
All electronic products must remain unopened with an unbroken seal to manufacturers packaging to be eligible for a return and refund.
You remain responsible for any associated postage charges for returning a Product. Postage charges will vary based on size and weight of the Product being returned.
Damaged or Faulty Product. You have thirty (30) days from the date of receipt of a Product to request a return or refund of a damaged or faulty Product. We request that wherever possible you bring to our attention any damaged Products within five (5) days of receipt to help our Partner identify and resolve the issue promptly.
Returns. If you want to return your Product for any of the reasons listed above, please follow the instructions below.
Please read the FAQ document which can also be found in your order history on your Perkbox account. You will receive an initial response within two (2) Business Days after having made a successful request and further instructions be provided.
Please do not send your Product/Order back without contacting us first.
Exchange. We cannot exchange a Product. Please follow the returns policy and re-purchase the Product(s). You remain responsible and liable for any associated postage fees unless the Product is damaged or faulty and purchases remain subject to availability of the Product(s) and Reward Points available to you.
If you are returning a Product, make sure you get proof of postage where possible and keep hold of it, in case we need to see it later.
Exclusions. The returns policy does not apply to Products which are not suitable for return due to (i) health or hygiene reasons, (ii) opened/broken seal (iii) if the product is no longer in the same condition as received, this excludes outer packaging where applicable, and (iv) perishable items.
Once we receive your return, we will also notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a refund equivalent to the Price will be applied to your Perkbox account. We will endeavour to so within fourteen (14) Business days however this may take longer.
8. Our liability and responsibility
We shall have no obligation, duty or liability whatsoever in contract, tort (including negligence, breach of statutory duty and any other tort) or otherwise, save as expressly provided in these Terms of Sale.
If we fail to comply with these Terms of Sale, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms of Sale or our failing to use reasonable care and skill but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time our Agreement was made.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence and for fraud or fraudulent misrepresentation.
We will not be liable or responsible for any failure to perform, or delay in performance of any of our obligations to you that is caused by events outside our reasonable control (a "Force Majeure Event").
9. Governing law and jurisdiction
These Terms of Sale are subject to the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction over all claims or disputes (whether contractual or non-contractual) arising in relation to, out of or in connection with these Terms of Sale.
